1. General terms

 

An “Insemination contract” must be signed with the owner of the animal before the first insemination is conducted.In the case of shipped sperm an additional contract has to be signed with the person in charge of the insemination. A certificate of the mating is issued (Deckschein). The delivery of this certificate (also to the association in charge) is only done if all the costs of the mating are paid. The certificate can only be issued and delivered when you can show us a genealogical certificate of the mare (copy)

 

2. Shipping of the sperm

 

The mating season begins on January 15 and end on august 15 Exceptions according to prior agreementOrderings of sperm for the following day must be placed before 10 a.m. during the week (Monday to Friday). On Saturday until 09.00 a.m. On Sundays and on holidays no shipping of sperm is possible. The delivery of the sperm is conductead via a private company to the veterinary in charge and has to be paid separately A maximum of 3 portions can be sent per rut. The container of the sperm and the signed sperm certificate have to be sent back within one week. Containers that have not been sent back have to be paid. Deep frozen sperm will only be shipped after receiving a shipping container or after having paid for the rental of our container (in advance).

 

3. Mating Hygiene

 

Mating without previous veterinary examination is approved of for -Mares with foals after a uncomplicated birth-maiden mares upt to 3 years of age. It is recommended to conduct a smear test. Additional veterinary treatment has to be paid separately. In case of an emergency we are entiteledto bring the hors to the next clinic.

 

4. Liability

 

The owner of the stallion is only liable for those damages that were caused by him or his assistan by intention or wantonly negligent. The limits of liability encompass all damages that may happen during the stay of the mare, especially when the mares are brought to the stallions. The owner of the stallion is not responsible for damages caused by a third party. The owner of the animal needs to effect an indemnity insurance to cover the risks of the ownership of animals (§833, 834 BGB).

 

5. Place of fulfilment and place of jurisdiction

 

The place of fulfilment is the registered office of the owner of the stallion.For any claims in the present and the future the exclusive place of jurisdiction is the registered office of the owner of the stallion. Jurisdiction: Bad Saulgau
